Visa condition 8202 is a rule that applies to overseas students in Australia. This rule was changed slightly, in April 2013, to stop the automatic cancellation of student visas.
What is visa condition 8202?
This condition requires you to maintain a certain level of attendance, in all of your courses. It also requires you to achieve a satisfactory level of academic progress. Visa condition 8202 tells you that, in addition, you need to be studying a registered course.
Registered courses can be found in the Commonwealth Register of Institutions and Courses for Overseas Students.
Education providers were previously able to cancel your visa automatically, by reporting you if you did not maintain satisfactory attendance or progress. (There was an exception, where leniency due to certain circumstances could be demonstrated within a strict twenty-eight (28) day time period).
Changes made in 2013 stopped automatic cancellation
There were changes made to the visa conditions in April 2014. Education providers are no longer able to issue a notice to students that will lead to automatic cancellation of their visas.
The decision to cancel a student visa is now made by a Department of Immigration officer.
This doesn’t change your attendance or progress requirements, however. You still have to do the right thing… and it’s better to be safe than sorry!
